    DK user ‘stevedakota’ the winner of 3rd place and $100,000 in last night’s DraftKings Milly Maker and possibly a lot of other money from other contests last night and before, operates another DFS site.

    According to his twitter bio he is the CEO & co-founder of FantasySpin. FantasySpin describes itself as “daily fantasy” multiple times in its app’s description in the Google Play store.

    By DK’s own rules after the Ethan Haskell situation, he is and has been ineligible to play in public contests. I have reached out to Jon Aguiar, Matt Kalish, and Jason Robins with no response, and I sent DK support an email with no response. Jon Aguiar retweeted stevedakota though during his sweat last night.

There are no salaries or roster construction, outside of locking in players the same way you hold cards in video poker. There is no possible edge that could be gained by him playing on DK or someone from DK playing his app.

    Seriously? What is wrong with people? Why would you want to ruin his win? I think it’s pretty clear he did nothing wrong. The rules were put in place so people don’t gain an unfair advantage. It’s abundantly clear he isn’t gaining any advantage whatsoever. In fact, one reason rake keeps going up is because of people like you. I wouldn’t be disappointed if DK suspended your account for a period of time for being a pain in the ass.

    From the wording of DK TOS the OP actually has a leg to stand on. I dont know why people are giving him a hard time. It clearly states the rules and he clearly broke them. Why anyone is even bringing up papa/chip is laughable and isnt the same at all. This is completely different.

    All you need to know is that the person that won 3rd runs a daily fantasy site that people can wager money on…. end of discussion. Thats against the TOS.

    FYI, I could give 2 shits about the person that won but the rules are in their for a reason, I am sure DK didnt see this happening when they made the rules and just wanted to cover their basis and left it open on accident for something like this to happen. But hating on a person when he brings a legit complaint is uncalled for.

    what is the actual wrong doing here? there is no insider information or edge? i can understand people using this as an example of how poorly worded the TOS are, and the many problems with their TOS selective enforcement (like allowing collusion etc). i think the attacks on the op are b/c he seems to be implying some scam and subsequent cover up occurred.

    lets be honest, the guy does not run a DFS site, but a fantasy sports site. i don’t think its close to DFS. Again, maybe a problem with the wording, but anything having to do with fantasy is not DFS. Does the TOS mean that if I start a website offering season long MLB for 10 bucks a league I could no longer play on DK?

    here’s the OP’s image. does the guy’s site meet any of the things mentioned in that question? no…the key phrase i think is proprietary data, and there’s isn’t any evidence the guy used insider info.

    Here, we’re talking about a company’s terms & conditions. Here, I think it’s fair to take a step back and evaluate the reasons behind a term or condition, and consider whether it would be justly applied under the current circumstances, and, really, whether anyone would be prejudiced by its failure to be strictly applied. This doesn’t even take into account the factual murkiness of whether a term or condition was even violated based on the nature of the mobile site here.

    Of course, my comments above are wholly separate from the thrust of my original post that you responded to. In my original post, I was really expressing distaste that anyone would take the time to pursue this by emailing the site to try and get this person’s win voided. Regardless of whether the T&C would be justly applied, it’s fair to offer an opinion that what the OP did, and continues to do, is utterly mean-spirited and even cruel. The OP was not personally prejudiced by this person’s win. Nothing unfair occurred.

    FFS, that isn’t anything like DFS. As I said, I understand complaints about the TOS being poorly worded (hell you’ll find lots of my comlliants about this in the Matt Kalish interview and Papagates collusion threads) but i think one has to be either unaware of what Dakota’s site is, or have an agenda, to think this is some sort of cheating and cover up scandal.

    i mean if having a slot machine randomly pick players is DFS, than so is my handshake bet with my buddy that dom smith will be more productive than greg bird (actually there is more forethought in my friendly bet than in the slot machine site)

    Your post is contradictory. You dont give “2 shits” about the guy who won 100k but you care enough about the OP’s feelings to say that all who oppose his absurd, jealous view are “hating on a person”. You’re the hater if you wanna take 100k from a guy for this BS. Make a decent lu and win some cash instead. FYI, (as you say) I dont give 2 shits about you, the OP or the 100k guy, but I’m not enough of a petty d-bag or a lunatic to think the little nonsense app he runs has anything to do with DFS at all.

    Maybe Steve Dakota can use his winnings to turn his NFL slot machine app into a successful DFS company and then make sure that his NFL slot machine app turned successful DFS company has clearly defined TOS in order to prevent the next NFL slot machine app entrepreneur from having his 3rd placed lineup questioned because of some flimsy, semantics based technicality?

    except the winner did not break any rules. he is not an employee of a DFS site. he developed a sports slot machine with the word fantasy in the title. the OP misundersood or misrepresented the case.
