    MONTGOMERY, AL (WAFF) – Alabama Attorney General Luther Strange announced Tuesday that he has issued cease and desist letters to DraftKings and FanDuel after reviewing Alabama’s gambling statutes and determining that paid daily fantasy sports contests constitute illegal gambling.

    “As Attorney General, it is my duty to uphold Alabama law, including the laws against illegal gambling,” Strange said in a written statement. “Daily fantasy sports operators claim that they operate legally under Alabama law. However, paid daily fantasy sports contests are in fact illegal gambling under Alabama law.”

    In Alabama, an activity constitutes illegal gambling if a person stakes something of value on a contest of chance, even when skill is involved, in order to win a prize.

    In paid daily fantasy sports contests, players create a “fantasy roster” of real-life athletes. Each athlete is awarded points based on his or her performance, and the “owners” of the teams with the highest scoring rosters win cash prizes.

    In Strange’s statement, he writes:

    There is, of course, a measure of skill involved in creating a fantasy roster. But in the end, contestants have no control over the performance of the players on their rosters. For example, a player could fall ill before a game, be injured in pre-game warm-ups, or miss a large portion of the game due to injury or equipment failure. All of these factors, and many more, are outside the control of a fantasy sports player. Thus, the results of paid daily fantasy sports contests depend to a large degree on chance. This is the very definition of gambling under Alabama law.
    Alabama now joins 11 other states in which paid daily fantasy sports contests have been declared illegal.

    DraftKings and FanDuel have until May 1, 2016, to cease offering paid daily fantasy sports contests in Alabama.

    It is a sad day in our state. Our law makers can not balance the budget and our Governor is pulling a Bill Clinton. State workers are getting laid off and these retards refuse to allow a lottery and now say DFS is gambling. However, I can go 2 miles down the road to a tomahawk casino. This is all just f****d up.

    Legislative answer not coming now in Alabama
    Alabama had two active bills regarding the legalization and regulation of DFS. However, the bills have not made any progress in the past two months, and both now have a status of “indefinitely postponed” on the legislative website.
    The House version of the bill came up in front of the full chamber in March but was sidelined after a contentious debate on the floor.
    The Alabama legislature is expected to adjourn on May 4.

    Looks like we may be without DFS for a while.

    On DraftKings you can still play as long as you are not in the state even if you currently reside. Just get a location spoof app and use it. I did this and it let me enter a contest tomorrow and I’m in Alabama. However, FanDuel does not allow you to reside in the actual state. Sent an email to FanDuel and live chatted with DraftKings for the information.

    I drove across the border to FL to enter last night and with DK can late swap and edit lineups from AL later. Also with DK putting up some larger contests days out I will continue too play there on and off. Football season should be fine with ability to take one trip across for the week. Fanduel is not usable as I can’t edit or do anything residing here. So I’m cashing out FD and moving it all to DK. Nothing will happen this legislative session (is what I was told off the cuff when I finally got my rep on the phone). What a disgrace.

    No they didn’t tell me how to I already knew how to do that. Haha. The guy in chat simply said that if I was to drive across the state line and not be physically in Alabama I would be able to play.

    Careful with deceiving location. Back when Pokerstars was first banned I had a buddy who was using VPN and got caught when it dropped (i.e. you can’t move from 1000 miles away to a new location in 2 hours. They not only closed his account but seized the 15k he had in his account for violating TOS and potentially subjecting the company to violation of US law. I haven’t read DK TOS but just realize there’s risk there and the company is definitely focused on toeing the line with the hope of a return to the state markets they’re currently held out of.

    Both bills that would allow DFS to stay in Alabama have been indefinitely postponed. So, it would be the next legislative session before it would come back up for vote.

    I live in Idaho and DK just restricted my account today. What pisses me off is they run a state lottery in Idaho, a giant scam, and there’s legal casinos here, another rip off. So I guess gambling is OK here as long as the hypocrites are the ones raking in the money.

    I live in Idaho also and FD and DK both sent emails today saying they are not allowing DFS in Idaho. I didn’t even know this was going to be a problem here, today is the first time I have heard anything about Idaho.
