    MONTGOMERY, AL (WAFF) – Alabama Attorney General Luther Strange announced Tuesday that he has issued cease and desist letters to DraftKings and FanDuel after reviewing Alabama’s gambling statutes and determining that paid daily fantasy sports contests constitute illegal gambling.

    “As Attorney General, it is my duty to uphold Alabama law, including the laws against illegal gambling,” Strange said in a written statement. “Daily fantasy sports operators claim that they operate legally under Alabama law. However, paid daily fantasy sports contests are in fact illegal gambling under Alabama law.”

    In Alabama, an activity constitutes illegal gambling if a person stakes something of value on a contest of chance, even when skill is involved, in order to win a prize.

    In paid daily fantasy sports contests, players create a “fantasy roster” of real-life athletes. Each athlete is awarded points based on his or her performance, and the “owners” of the teams with the highest scoring rosters win cash prizes.

    In Strange’s statement, he writes:

    There is, of course, a measure of skill involved in creating a fantasy roster. But in the end, contestants have no control over the performance of the players on their rosters. For example, a player could fall ill before a game, be injured in pre-game warm-ups, or miss a large portion of the game due to injury or equipment failure. All of these factors, and many more, are outside the control of a fantasy sports player. Thus, the results of paid daily fantasy sports contests depend to a large degree on chance. This is the very definition of gambling under Alabama law.
    Alabama now joins 11 other states in which paid daily fantasy sports contests have been declared illegal.

    DraftKings and FanDuel have until May 1, 2016, to cease offering paid daily fantasy sports contests in Alabama.

    I joined two weeks ago Jeremy, in anticipation of the C&D. I haven’t played any cash games, but usually will play a freebie MLB daily. The only difference, apart from FD, is the extra pitcher. I was drawn to Yahoo because the fact that I live in West Mobile and commute to Miss for work and they’re allowed there, so that was my first choice going forward.I also joined a free season-long Rotisserie league (by accident) but enjoying it nonetheless.

    Bad news: won’t let me add funds due to geographic location. Seems only free entries are allowed. Fan Duel won’t even allow that.

    Does anyone know what happens on FD if you were playing in contests from a banned state, but were able to enter said contests by driving over the border or having a friend enter them, and you won a large sum of money? (Say for example, you took down the NBA Shot for 50K). I have never won that sort of cash, but am weary of what would happen if I did and I was playing from a banned state. Would your winnings get revoked?

    Due to recent developments concerning paid Daily Fantasy Sports (DFS) in Alabama and Idaho, Yahoo will suspend offering paid DFS contests to residents of both states pending further review.

    Any entries you have for upcoming contests or contests that are under way will be allowed to finish. You will continue to have full access to your account to withdraw funds. You will not be able to add funds or enter new paid contests.

    On FD if your address is in Alabama then you are shit out of luck just like me. The terms of service of FD say you can not enter contest if your physical address is in the state of Alabama. However, if you would like to play on DK and drive to another state and enter, you can do this. At least that is what I was told.

    I’m in Texas and as of yesterday no mas FD for me. Took them a couple of extra days after May 1st. Guess that goes for DK as well as it would not take my deposit. I can certainly live with or without fantasy sports, just was a bunch of fun for me. So what sites are you guys finding that the banned stepchild states can still play in? Thanks.

    Played Yahoo and Fantasy Draft last night but both are restricted today. Fantasy Aces and driving to FL for DK is it for me. OMFG this is lame!

    I traveled over the border to FL yesterday afternoon to enter DK contests and the ones last night ran fine, but I just looked into my account and the entries I made for tonights games had been deleted. Waiting to hear back from DK but this raises concern that they may not be allowing even buy ins from allowed states by players residing in restricted states. I’ll follow up when I know more.

    DK banned me for 6 months for violation of “one use, one account”, which they wouldn’t discuss in detail but I have to think is because I drove across to FL yesterday to enter my contests and then was working on editing the lineups today for tonight’s games. BS since it’s all me, but I guess they’re just being careful. So I guess that’s it, I’m retired from DFS. Good luck to all those lucky enough to still get to play a game that doesn’t hurt anyone. What a fucked up country we live in sometimes. It’s enough to make me vote for Trump. lol

    F, F, F. Just had Fantasy Draft refund my $22, $5, and $1 entries for today. They are shutting down in Bama. 3 extra days were too good to be true.

    I tried to make a deposit at DK last night and the site would not take my money. I have been e-mailing DK and they said it must be my card as Texas residents are still allowed to play and operate their accounts as normal. Thought that if FD was banned from Texas so would DK. We’ll see how long it lasts. Sorry for all who cannot play, but seriously, don’t vote for Trump! lol

    In Texas, FD decided to ban paid contests in an agreement with our sorry-a** AG. DK is suing the AG in a court in the Dallas area. The AG wants to move the suit to a court in Austin and is trying to get it quashed. We will see what happens next. I will be in Ohio next month and will try DK. I have heard that FD goes by where you live and not where you are. If that is true that is illogical. It is like saying that I can’t go to a casino or horse track while in vacation in Ohio or another state because I live in Texas.

    I don’t think I will vote for Trump either – but that is a topic for another type of forum.

    No, never made any second account. I think they’re basically saying being on DK at different locations in a short amount of time (Pensacola FL yesterday at 4PM then my home in AL at 6PM editing lineups and again in a different city in AL where I work this morning) triggers their suspicious activity rules or something. Basically my plan of driving across a couple of times a week and entering everything on a place holder lineup for that day and the next day and then editing from home is not OK with them. So good luck. Still playing on fantasy aces but the legal sports report site says they’re not live in AL anymore either so waiting for that shoe to drop.

    Was most pissed because I spent 90 minutes driving there and back to have entries cancelled and account suspended for 6 months when I could have kept it live and just played when I was vacationing or traveling for longer periods this summer, but THEY TOLD ME it was fine to enter from FL and edit from AL. Terrible that they won’t follow their own advice.

    My thoughts exactly..as I said..as a resident of Alabama.. I’m still allowed to go to GA and buy a lottery ticket..so the same should hold true for entering a DFS game..right?
