    MONTGOMERY, AL (WAFF) – Alabama Attorney General Luther Strange announced Tuesday that he has issued cease and desist letters to DraftKings and FanDuel after reviewing Alabama’s gambling statutes and determining that paid daily fantasy sports contests constitute illegal gambling.

    “As Attorney General, it is my duty to uphold Alabama law, including the laws against illegal gambling,” Strange said in a written statement. “Daily fantasy sports operators claim that they operate legally under Alabama law. However, paid daily fantasy sports contests are in fact illegal gambling under Alabama law.”

    In Alabama, an activity constitutes illegal gambling if a person stakes something of value on a contest of chance, even when skill is involved, in order to win a prize.

    In paid daily fantasy sports contests, players create a “fantasy roster” of real-life athletes. Each athlete is awarded points based on his or her performance, and the “owners” of the teams with the highest scoring rosters win cash prizes.

    In Strange’s statement, he writes:

    There is, of course, a measure of skill involved in creating a fantasy roster. But in the end, contestants have no control over the performance of the players on their rosters. For example, a player could fall ill before a game, be injured in pre-game warm-ups, or miss a large portion of the game due to injury or equipment failure. All of these factors, and many more, are outside the control of a fantasy sports player. Thus, the results of paid daily fantasy sports contests depend to a large degree on chance. This is the very definition of gambling under Alabama law.
    Alabama now joins 11 other states in which paid daily fantasy sports contests have been declared illegal.

    DraftKings and FanDuel have until May 1, 2016, to cease offering paid daily fantasy sports contests in Alabama.

    DK banned me for 6 months for violation of “one use, one account”, which they wouldn’t discuss in detail but I have to think is because I drove across to FL yesterday to enter my contests and then was working on editing the lineups today for tonight’s games. BS since it’s all me, but I guess they’re just being careful. So I guess that’s it, I’m retired from DFS. Good luck to all those lucky enough to still get to play a game that doesn’t hurt anyone. What a fucked up country we live in sometimes. It’s enough to make me vote for Trump. lol

    I feel the same way my friend. What you did was what the DK customer support said I could do. I can not do this because I live in the middle of the state and I am disabled. I guess I am retired to. This sucks goat balls. Our state can’t balance its budget and every form of revenue like lottery’s and DFS is banned. It Makes No Sense.

    Yeah I saw this update and am currently 1st and 2nd in the 27.50 and 2.75 tournies on Fantasy Aces so I hope it’s a misprint!!!

    In Texas, FD decided to ban paid contests in an agreement with our sorry-a** AG. DK is suing the AG in a court in the Dallas area. The AG wants to move the suit to a court in Austin and is trying to get it quashed. We will see what happens next. I will be in Ohio next month and will try DK. I have heard that FD goes by where you live and not where you are. If that is true that is illogical. It is like saying that I can’t go to a casino or horse track while in vacation in Ohio or another state because I live in Texas.

    I don’t think I will vote for Trump either – but that is a topic for another type of forum.

    Where in Ohio? I was born and raised just outside of Youngstown.

    Played on FA last night and yesterday (and won everything on there 27, 11, and 2.75 tournies at night and 27, 2.75 on day slate so GLAD I DID). I tried to log into my account through my phone last night and it wouldn’t let me in but on my laptop it’s still working fine and I put in lineups for tonight. So seems like that’s an option still through a hard line until it closes too!

    I played last night on FA too. However, I just tried to put in a lineup for tonight on FA. Everything looks the same, no notice or anything, but when I go to draft new team, just get a refreshed screen. I am blocked. Frig. Really nothing now. Unreal. On a side note, I was contacted by the Birmingham News and they said they were “looking for a strong piece from someone who plays in the state. I just submitted them a piece this morning. They just asked for a head shot and said they are going to run it online on AL.com. Like pissing in the wind but at least the papers are interested in this issue. I obviously think that if there are bills in the hopper that the cease and desist should be lifted until there is a full discussion. I sure wish there was something systematic I could do on the ground.

    That is what I was hoping for. That the cease and desist be lifted until there is a full discussion. I emailed FA before I joined yesterday and this is what they said.

    Yes, we are still operating in Alabama at the moment until further notice so AL residents are able to deposit and play on ACES. Our legal and management team are reviewing the AL issue. Should we need to cease operations in that state, we will make an announcement. In any case, you will have access to your funds if we can no longer operate in AL. Please let us know if there is anything else we can do for you.

    my lineups are live tonight on FA though not doing great! So I’ll just keep playing until they tell me I can’t. Let’s just hope the withdrawals go smoothly.

    I tried a deposit to FA today and got this. Funny thing is I never got as far as the credit card. They try to string you along for as long as possible to get as much of your money as they can.

    So, we can go to TN and enter contests on Draftkings right? I want to go Saturday and buy some lotto tickets and thought I would try to enter a couple nascar linups and the MLB.

    From Fanduel’s own website, “Yes. You can play when you are physically located in a state from which FanDuel allows play. But if you are a resident of a restricted state and we have questions about your location and cannot determine to our satisfaction that you are in are in permitted state, we may block your play.” So you can drive over to Florida and enter your lineups. I’d just email them and talk to them if you have trouble, because it is basically the same as buying a lotto ticket in FL.

    It was DK. They said my activity was suspicious for multiple user activity, which I’m assuming was logging in from multiple states within like 90 minutes. Basically my plan of driving to FL and buying into everything with a throwaway lineup and then coming back to edit and work on things didn’t work. Hope it does for you all. FA locked out today too, so I guess that’s it for me with DFS for at least the year. Also saw that the house of reps here gave Rep Rowe the “black shroud award” that they give out at the end of each house session to the rep who introduces the most “dead on arrival” bill in the house. You guessed it, DFS bill. So we are likely done for the foreseeable future. I would guess several years at least even if it moves forward in many other states. Time to find a new hobby.

    Very well done Mr. Clair. Thanks for taking the time putting that together. My father is retired living in Alabama too and he is exactly in the same boat as you. Loves the entertainment and thought process/research he gets to put into playing Daily Fantasy.

    As for the comments…..that is a difficult task to take on. Especially when they remain nameless & faceless.

    I would not get involved in comments, as the only result will be irritation for you and pleasure for the trolls. You’ve said your part and done it well. Consider Colorado for a move if you decide to. It’s a wonderful retirement state, just wait until they get their bill through!
