    MONTGOMERY, AL (WAFF) – Alabama Attorney General Luther Strange announced Tuesday that he has issued cease and desist letters to DraftKings and FanDuel after reviewing Alabama’s gambling statutes and determining that paid daily fantasy sports contests constitute illegal gambling.

    “As Attorney General, it is my duty to uphold Alabama law, including the laws against illegal gambling,” Strange said in a written statement. “Daily fantasy sports operators claim that they operate legally under Alabama law. However, paid daily fantasy sports contests are in fact illegal gambling under Alabama law.”

    In Alabama, an activity constitutes illegal gambling if a person stakes something of value on a contest of chance, even when skill is involved, in order to win a prize.

    In paid daily fantasy sports contests, players create a “fantasy roster” of real-life athletes. Each athlete is awarded points based on his or her performance, and the “owners” of the teams with the highest scoring rosters win cash prizes.

    In Strange’s statement, he writes:

    There is, of course, a measure of skill involved in creating a fantasy roster. But in the end, contestants have no control over the performance of the players on their rosters. For example, a player could fall ill before a game, be injured in pre-game warm-ups, or miss a large portion of the game due to injury or equipment failure. All of these factors, and many more, are outside the control of a fantasy sports player. Thus, the results of paid daily fantasy sports contests depend to a large degree on chance. This is the very definition of gambling under Alabama law.
    Alabama now joins 11 other states in which paid daily fantasy sports contests have been declared illegal.

    DraftKings and FanDuel have until May 1, 2016, to cease offering paid daily fantasy sports contests in Alabama.

    I made a couple NASCAR lineups and an MLB lineup while in Tennessee without any trouble. We were just right across the state line. I had to make a few edits to the MLB lineup when I got home here in Alabama and did so without any trouble. Everything went live and is being scored like normal. Now, to wait on those lotto numbers tonight..lol.

    I just learned that Cheeseisgood (Dave Potts) is an Alabama resident. Heck, his extra 6 figure contributions to the State should be enough to wake these folks up. Good lord.

    I am having trouble understanding how, using this justification: “contestants have no control over the performance of the players on their rosters” individuals from the state of Alabama are allowed to have investment portfolios.

    Dam, he is number 58 overall. I have seen his name in several 50/50 on Fanduel. Did not realize he was from our state.

    In all my emails and calls to legislators I highlighted the fact that all winnings are reported and taxed. The amount of state taxes I have paid the past couple years are more than just a drop in the bucket. But it’s not just me, there are thousands of players in AL who have paid taxes to the state from DFS. From the responses I got, they either didn’t understand the industry, or didn’t care to understand it.

    Just got this e-mail from Fan Duel a half hour ago:

    It doesn’t appear that Alabama will have another legislative session this year unless a special session is called. So, we most likely be without DFS until they meet again in 2017. Even then, there is no guarantee that it will even come up for vote. I would like to see the Attorney General lift the cease and desist order until the bill can be voted on. I don’t expect that to happen. I guess we don’t have much of a choice. As stated before, for the time being, those of us that live near state lines can cross over and create lineups on DK, and return home to edit those entries. Other than that, we need to continue to call our local politicians and try to get as much attention drawn to the subject as possible and hope they can push something through next year. If a special session is called, then I think it would have to get the governor’s approval for discussion.

    You can play on Fanduel now in Alabama in the Summer Free for All contest. Its not much but, if you are desperate for a little DFS action it beats not playing at all.

    There has been some discussion that a special legislative session will be be called later this summer or early fall. I know the major talking point will be funding the medicare/medicaid budget. I don’t know if the Fantasy Sports Bill can or will be brought up during this session but it would be nice to get them at least talk about it again.

    You need everyone with a heart beat that u know who plays DFS down there to get on the horn, make calls and do emails…..try to get some of those ppl on your side…or the side of DFS that is

    The first thing I am going to try and do is find out if it even possible for it to come up for discussion in a special session. I suggest all of you that live in here in Alabama to call and email and try to find out the same information. I will report back if I can find any info out. I don’t mind driving to Tennessee or Mississippi to play every now and then but it would be nice to play here at home again and in time for football season.

    I contacted Paul Sanford who was backing the bill in the last legislative session and he said it was unlikely to be brought up in a special session and probably not have much of a chance in the next regular session given the AG has declared in gambling and gambling is illegal in the state of Alabama. Looks like DFS is done here.

    I would let Mr. Sanford know that both the AG’s in bordering states (Tennessee & Mississippi) ALSO declared DFS gambling and that their legislatures were able to change that designation through legislation. If they can figure out how to do it…..I’m sure Alabama should be able to as well.

    He was aware of the MS and TN rulings. We’ll just have to wait until the next legislative session to have any sort of chance, imo. Until then, I’ll keep crossing the state line (s) a couple times a month to play.

    The Governor will call a special legislative session most likely early next month. In a statement this morning he declared a state lottery would help alleviate the financial crisis and urged Alabamians to call their reps and ask for their support so this can be on the ballot in November. I wish they would sneak DFS in with it. Doubt they will though.

    I love how some of these states (with supposed conservative values) will openly turn to a lottery to fund their state problems, but then say that gambling or DFS should be illegal. Go f*&k yourself Alabama.

    Any news on whether or not DFS will be discussed in the upcoming legislative session? I’ve looked around but can’t seem to be able to find anything. Last year the bills were just tabled so they didn’t take any action. Hopefully this year they will pass legislation so we can play in state again. Having to drive to MS isn’t that big of a deal but I would play more often if i could just enter my lineups from home.
