    Big win in Illinois!

Today the federal court dismissed the entire action against FanDuel and Pat Kaiser. We are really pleased that the federal court recognizes that FanDuel and other fantasy sites cannot be sued under the Loss Recovery Act. This is a great day for fantasy sports, sites and players alike.

The full judgement can be found here: http://www.scribd.com/doc/174894588/Langone-v-FanDuel-and-Kaiser

This shouldn’t concern you at all – “QUESTIONS OF FACT” under our common law system are questions solely for a JURY. As such, a trial court can NOT grant a summary judgement when a question of fact exists. It’s a procedural question only. Not a concern of the matter at hand.. blah blah blah.. plus footnotes carry even less weight than dicta. bleh bleh bleh… hrumph hrumph hrumph.. Give the governor a hrumph!
    and gratz to the industry.

Great news! However, I’d feel so much better if a court ruled that DFS is indeed a game of skill. Until that day, there will always be a small cloud hanging over our industry.

  • fishkillers

too much blah blah blah – sorry guys –
EVEN IF it were to be considered gambling – the court drew an analogy to parimutuel tickets and deemed that the sites would not be liable…

As it stands, DFS IS considered a game of skill under the eyes of the law – and its prolly better for now if this issue isn’t re-addressed in the courts, the legislatures or otherwise.. ;o

Judge Durkin really doesn’t like Mr. Langone, LOL.

Great win here for FanDuel and the original DFS player, Mr. Kaiser.

Considering it’s the same lawyer who tried to explain how he was entitled to 180K for doing next to nothing….do you blame him?

Let me get this straight. A guy played some DFS, lost, and tried to sue to get his losses back?

Oh what a world we live in.

No, Cruz, it’s even worse than that.

A lawyer realizes that there exist players who have played DFS and lost, and said lawyer is trying to recover those losses for himself without having any connection to those players who suffered losses.

Nope, believe it or not he tried to sue for other peoples loses! It is the most messed up law in the world and yes, it exists.

Best thing you could do is read the link that Cam posted. It explains it all very well and I am not sure it is possible to do in a few sentences.
Maybe other then jerk sues DFS site for other peoples loses based on obscure & ridiculous law.
