How is this legal. Is there a precedent. They are claiming it was for gambling so it is not refundable even though daily fantasy games were listed as games of skill

Sounds a little fishy but from a personal finance standpoint taking cash advances on a CC for DFS or gambling is a red flag. Probably should re-evaluate whether you can afford the amount you are playing.

I think the OP is saying they are charging cash advance fees for deposits, but it shouldnt be as he is not making cash advances.

I dont get charged the fees for DK but on Pokerstars I do

Did you deposit into DK Fantasy Sports, or DK Sportsbook ?

Most cards will take transactions for gambling as cash advances. I’m not sure there is much you can do but learn from it.

Hopefully DK Support can help you navigate the situation.

Out of curiosity, did you run the deposit through something like PayPal, or was it a direct charge against a credit card number you provided to DK?

Either way, the credit card company is who I would have issues with. They would definitely lose my credit card share of wallet, and they might lose the rest of my banking relationship along with it over some foolishness like that.

I also ran into this being in Colorado there are a bunch of new sportsbooks. Some take CCs some don’t. I like to use my CCs for cashback purposes, so Citi hit me with a couple $10 cash advance charges. I called and got one of them waived, but why does it matter what I spend my money on?

Sites like MKF and such you can use a CC with no fees, but each sportsbook treats it differently on what they will take for a deposit, some will only take bank accounts. I’m extra careful now and have changed my cash advance limit to 0 on my card so I don’t get that again. I’m playing on 6 or so different apps. One thing you can do is use Paypal, but link your credit card through paypal for the cashback. Chase has 5% cashback this quarter on Paypal.
