Good to see that DK has hired the law firms Gibson Dunn and Boies Schiller. These are truly two of the top law firms in the country and have many many connections. I personally worked 15 at years at one of these firms and can attest that their attorneys are among the best of have many and powerful sources outside of the firms to help their client’s cause. For those of you interested, google the names David Boies and Randy Mastro who will be leading the fight, I’m sure you come to the same conclusion as me and that is in the end DFS will still be in daily landscape. Go get Em!!!!!!!!!!

Definitely encouraging but wouldn’t it make more sense for FD and DK to join forces and pool their resources to make sure they both get the best representation possible? They are in the same exact fight. They are either both going to win or both going to lose.

Lets say FD goes cheap and doesn’t get the best representation like DK and FD loses their court battle. Wouldn’t that hurt both companies? I can’t imagine a situation where DK is allowed to remain open in NY but FD isn’t.

No, two bullets instead of one.

I concur, I’m pretty sure that FD and DK have been in contact with one another. As a result, like others said, if they both attack on their own then the AG has to defend his position twice.

Unlikely that the same firm could represent both companies. There are conflicts issues – for example the AG statement referred to deceptive advertising. To the extent that one company has a better argument than the other in connection with advertising, that would be a conflict. Same if it turns out their issues are not exactly the same in connection with the “insiders information” issues. Certainly their lawyers will coordinate strategies, however.

That makes a lot of sense. Did Fanduel also hire a top law firm like Draftkings? I haven’t heard much about Fanduel’s representation.

Yes, Fanduel is represeted by Debevoise & Plimpton. They are a top firm of the same caliber as the firms representing DK.

NYS Judge denied temporary restraining order. DFS is going to get zero slack from the State. I don’t know why they didn’t file in Federal court

They are also represented by Marc Zwillinger. Seems highly qualified.

They couldn’t. There is no basis for federal jurisdiction. The only way you can get a federal court to step in and enjoin action by a state to enforce its laws is if the law or the state’s interpretation of the law violates federal law or the U.S. constitution.

They ordered them back on the 25th so the judge denied it. The state claims they won’t do anything until to stop them until the final ruling in court. So buisness as usual unless they want to be dicks, which I guess they could.

I believe the AG made this statement to the Court, and being an officer of the court, there is no way I see the AG going against his word.

Im sure this is already known, but does anyone have any idea what the line in this article means?

“In the meantime, DraftKings said in a statement that it would continue doing business with New York customers.”

It means that they will continue doing business with New York customers, I think.
