    Statement from FanDuel

    FanDuel made the following statement via a company spokesperson:
    “We are announcing that as of today, FanDuel will cease offering paid contests in the state of New York per the terms of a settlement reached with the Attorney General on certain aspects of the ongoing litigation.

    New York is a critical state for FanDuel. FanDuel is headquartered in Manhattan, where we employ more than 170 young smart, passionate fans who are committed to innovating and providing the best fantasy experience possible. We are proud to be one of New York’s largest startup companies, and while it is disheartening for us to restrict access to paid contests in our home state, we believe this is in the best interest of our company, the fantasy industry and our players while we continue to pursue legal clarity in New York.”

    Statement from DraftKings:

    DraftKings Statement Regarding The Settlement with The New York Attorney General

    “Effective today, as part of a settlement reached with the Attorney General’s office, DraftKings will stop offering paid daily fantasy sports contests in New York State.

    We are an industry leader in technology, innovation and consumer protections, and we are grateful to the hundreds of thousands of New Yorkers who have enjoyed playing fantasy sports on DraftKings for the last 4 years. We will continue to work with state lawmakers to enact fantasy sports legislation so that New Yorkers can play the fantasy games they love.”

    I feel like there is another shoe to drop. I played FD and DK and they both seemed fine with moving on without NYers and leaving us behind. Before I join a 3rd site I want to see if NY has a chance at legalization for July 1st or if they go straight until Sept. In the meantime let’s see if FA can avoid getting shutdown in NY.

    Legislation will pass before July 1st iMO. I believe an assemblyman said around 85% it would. Aces and other small sites have no reason to back out of NY. They weren’t listed on the cease and desist, not listed on the lawsuits, and they didn’t agree to the terms FD and DK did. A 500,000 licensing fee is a death sentence to most small sites, they have no benefit to agree to stop taking NYers.

    Another question, how many of my fellow NYers are playing at FantasyAces? I am, I confidently put 2K in there. No worries about the site. I know my brother and 3 friends have all redeposited as well. Anyone else do it yet? Plan on it?

    On today’s RG Daily Fantasy Fix: “Dan talks with lead lobbyist of FanDuel and DraftKings, Jeremy Kudon, about the fight for legislative clarity for fantasy sports, where we stand in the most important states, and the best way for players to have a voice with their representatives.”

    Kudon, who has the added incentive of being a DFS player from NY himself, says he hopes to see something done by early May.

    So Mobile Strike has a Free DK MLB contest this week and even though NYers can enter free contests DK has the whole site location restricted so I contacted customer service and got this reply:
    “At this time we do not have any Free contests available for NY users. There will be more information regarding this in the coming weeks. I apologize for any inconvenience.”

    ETA: I’m hoping DK is referring to the fact that we will be legal by May. According to this article “Pretlow also said he’ll “probably have a bill by the end of April” regarding DFS.”

    I’m a fellow New Yorker that’s playing on Aces currently. I’ve actually grown quite fond of their site setup. Only short coming so far is it lacks the big $$$ payouts that draw a lot of people to the main sites (DK, FD). Seems like I play mostly the same people daily…

    I joined it, I actually like the cash games better at aces then dk, fd. The tournaments are small but they also have a monthly win bonus which I love. It’s basically free money at the end of the month. If I were you I’d definitely look into it at least. Go to the site and look around and email them with any questions. I found their customer service is way better than dk, fd.

    Yahoo pulled out of NY as well, its only aces that is legal in NY

    I am from NY and have been playing on yahoo until today it told me NY is a restricted state. Time to switch to Fantasy Aces I guess

    If I remember it correctly Kudon said on the podcast that part of the urgency it pushing legislation through was that they were aware that small providers were still operating in NY. He also mention trying to negotiate a waiver or reduction (can’t remember which) of the fee for small providers.

    I don’t see any reason to back out. The AG already touted this as a W because he got FD and DK to stop allowing us to play. He knows legislation is gonna pass, and got the publicity of winning. No reason for him to issue a cease and desist to aces. They’ve never been sent one, they weren’t involved in the lawsuit, and they weren’t involved in the potential deal being made. They’re actually getting screwed in the deal because they can’t afford a $500,000 licensing fee. Zero incentive to stop until legislation passes IMO.

    The big states, imo, are critical to DFS being recognized as a whole. If DFS is legalized in NY and/or Texas, I think that the rest of the country will be inclined to follow suite at some point. Obviously there still needs to be some efforts on the ground to make it actually happen in each individual state, but the big states (namely NY) are the most important to happen first. Plus, with the revenue from a state like NY back in place, there will be more cash to go towards efforts in the smaller states. Just my two cents though.
