Woke up to this unfortunate gem: http://www.legalsportsreport.com/9130/fanduel-draftkings-reach-ny-settlement

Thoughts with you guys in New York.

    Statement from FanDuel

FanDuel made the following statement via a company spokesperson:
“We are announcing that as of today, FanDuel will cease offering paid contests in the state of New York per the terms of a settlement reached with the Attorney General on certain aspects of the ongoing litigation.

New York is a critical state for FanDuel. FanDuel is headquartered in Manhattan, where we employ more than 170 young smart, passionate fans who are committed to innovating and providing the best fantasy experience possible. We are proud to be one of New York’s largest startup companies, and while it is disheartening for us to restrict access to paid contests in our home state, we believe this is in the best interest of our company, the fantasy industry and our players while we continue to pursue legal clarity in New York.”

    Statement from DraftKings:

DraftKings Statement Regarding The Settlement with The New York Attorney General

“Effective today, as part of a settlement reached with the Attorney General’s office, DraftKings will stop offering paid daily fantasy sports contests in New York State.

We are an industry leader in technology, innovation and consumer protections, and we are grateful to the hundreds of thousands of New Yorkers who have enjoyed playing fantasy sports on DraftKings for the last 4 years. We will continue to work with state lawmakers to enact fantasy sports legislation so that New Yorkers can play the fantasy games they love.”

Things New Yorkers need answered ASAP, Is this Location based or Residency based? and FantasyAces, Yahoo, and other sites, where do we stand?

I live in NY, tried entering a yahoo contest and was successful.

For now, i’m hoping for an announcement saying they will stay in business for us during mlb.

I emailed Fantasy Aces a minute ago. If they stay open I’ll just withdraw from DK and deposit that much into Aces.

Legalsportsreport stating this is only until September, which I imagine gives the big two the ability to return for NFL season.

    http://www.legalsportsreport.com/9130/fanduel-draftkings-reach-ny-settlement/

The concerning portions of the main proposed bill:
15% tax on gross revenue in the state – seems incredibly high for smaller sites to attempt to turn a profit.
$500k barrier to entry fee in NY (which paid taxes can be deducted from) is enormous, and smaller sites will not be able to afford this.

I confirmed with FD its location based…..

I have a question. Have a buddy in LA that I trust, I live in NY. Would I be able to have him log into my account and enter contests as well as lineups I send him? It says on FD I live in NY yet if “I” enter everything in LA and edit it there and never make a lineup in NY would this still be legal?

  • dirtydistance

I live in pa and now refuse to cross into New York to do any business.

So…I live and work in NY (in Albany right now) and am restricted from entering contests on FD but got a few in under the wire before that FD e-mail came through. Funny thing is that DraftKings is still taking contest entries. Just entered 15 $4 LUs into the $500K four Point Play and one $100 entry into the $400K Showtime Championship. I’ll update if anything changes, but it looks like DK might just not be taking deposits. also curious to see how my one remaining Survive the Madness LU (I won a ticket for Thursday) is treated, since the minimum I can win is already $250 — assuming I finish dead last.

Live in NY, entered 6 contests on DK last night. Will those still run and will I be allowed to edit? Pretty sure I just entered a dummy lineup

Yes, it is possible for him to enter contests under your name and then you can switch the lineups. This works on draftkings, not sure about fanduel

“New York law on this matter would not apply to New York residents when they are located outside of the state. So, residents who are outside of New York’s borders could play at the two sites when located in a state where DFS is legal.”

you’re good with it you just cant enter anymore and would need to withdraw if you win or wait til september.

  • damionismyname

Can I got deposit and enter in NJ then just edit whenever since I’d be already entered?

  • gyutae

  • JackLotte

FYI the email from DK says tickets and DK dollars will be converted to cash

I entered for NHL tonight, and now it won’t even let me back on the site, saying I’m in a restricted area (NYC). I will have to email them to cancel my entries I guess cause obviously can’t edit

  • Bighouse55

My accountant says I am committing fraud if I live in NY and leave state to enter contest and then drive back home.

    Can anyone confirm this?

    Thanks

  • scsa1998

My entry fees for tonights contests have been refunded to me.

Your accountant is wrong, I’d suggest asking a lawyer if you need more legal advice and just leave tax advice to your accountant.

  • kellykip

It let me back on but it auto-cancelled all my entries for tonight and refunded back to my account balance, so tonight will not be happening

  • PujolsJunkie

Just as my best sport is approaching, they shut down. Unreal.
