    Is anyone else having trouble getting paid out by Fantasy Up? I submitted a withdrawal request for some of my funds over a month ago but I still haven’t been paid, despite the fact that I have exchanged many emails with them They keep promising that funds will be paid out shortly but then they go radio silent until I email them again.

    Does anyone have any recommendations about what I should do if they continue to fail to pay? I would prefer not to take legal action because of the cost and inconvenience (and because up until now they’ve provided a good service) but at this stage I don’t know what other options I have.

    Sorry for all of you. But this isn’t offshore gambling, and there has to be a mile of proof they took deposits with no ability to pay back winners. There will be recourse. But yeah, massive black eye here.

    How recent are your Paypal deposits? You have 180 days from the payment date to open a dispute. Common reasons for a dispute:

    •You paid for an item but haven’t received it and the seller is uncooperative or nonresponsive.
    •You received an item that was significantly different than described.

    Click the Dispute a Transaction button in the Resolution Center to open a dispute. Then, provide more information about the issue and post a message to the seller.

    Transactions older than 180 days cannot be disputed but should still be reported. PayPal tracks seller performance trends in the event we need to take action to protect other buyers.

    Paypal may or may not be willing to help but they allegedly offer buyer protection on these type of purchases. I would say it’s worth a shot.

    Note: This would only apply to people who have money they paid on the site. If the bulk of your funds are winnings or your payments were more than 180 days ago you are out of luck. Even if they aren’t, you still might be out of luck, but it can’t hurt to try.

    I would urge everyone to file a class action lawsuit.

    By the sound of things, they knew they were in the red and continued to accept deposits without ever warning or letting their customers know that they are depositing their money in a failing company.

    That’s no way to handle a business and it’s downright unethical and illegal, IMO.

    I played last year during their no rake period up till baseball started. Didn’t play much there at all after that but still had a couple hundred sitting in my account. Checked back sometime in October and they were doing the no rake again and so started playing again. so started playing again. Could somebody tell me what happened in June and July that raised all these red flags?

    At this point it is sounding like some kind of Ponzi scheme. So they need to get us paid. Cash in IRAs sell the house whatever or face some prison time.

    If their plan was to pull a ponzi scheme they failed miserably. They paid out money through bonuses that they never took in. Players were playing rake free games while still earning $3 in bonus per $100 played I believe. Not a ponzi scheme but they were obviously using player funds to operate their business.

    In my mind there is no difference between what Dan Ziernicki had done to us and someone robbing a bank or any other kind of store. This is out and out robbery and we need to hold him accountable until our funds are paid to us or he is in jail. He thinks he can hide behind his shady LLC and everything will blow over. According to what people have messaged me and my own funds it looks like this guy has over 30k of our money.

    I typically always hit the pick 3 for 100. Hit the pick 5 once for 500.

    I’m not convinced that anybody has this money that was stolen. It was likely spent in order to keep the business operating. Either way, a criminal investigation is clearly necessary.

    At the very least this Dan guys accounts at fd and dk should be frozen. They had no intentions of paying out Emit. They continued to take deposits. FU ceased operations once the pressure started coming down on them. You played last night as well as others on that site.

    (e) so they closed their business. did they file bankruptcy? if so, when? why were they still taking deposits from customers until recently? where were those funds going? this can construed as embezzlement or willful misappropriation of funds to me in this scenario. quick search of internet (http://www.expertlaw.com/forums/showthread.php?t=84771) -> Just to add that in the dissolution of businesses, owners are required by law to liquidate assets, and pay creditors first, before themselves. If you can prove this is not the case, then you can go after the owners for fraud.

    (f) talk to a lawyer, maybe join your cases with others”

    IF the officers/owners were stealing money or have committed other fraudulent behavior, then there is a possibility to get the Owners of Fantasy Up on the hook personally, through what is known as Piercing the Corporate Veil. It would be wise for everyone who has had their money frozen to get in touch with whiskey tavon and then find out what state Fantasy Up is registered to do business in. Then I would contact a law firm in that state and go from there. Most firms offer free consultation.

    They are based in a suburb of Denver. Dan Ziernicki is the owner of the site. In the past he has been very prominent on social media and has exchanged tweets with many well known DFS players and did well playing on fanduel under the name DanWahoo. Lets organize everyone over the next few days and then pursue our next course of action. There are at least 20 of us in the same boat and lets just see what we can do to recover our funds or at least hold someone personally responsible for this theft.

    Pretty sure he changed FD names last year but I have no idea what his new screen name is. Just remember him saying the danwahoo name was retired.

    Sorry for everyone affected by this crap. This is the last thing DFS needs right now.

    They need to put everyone that had anything to do with this in jail for a long time.

    Other than the people that lost money, which really sucks, I also feel sorry for the other small sites trying to carve out a niche to challenge FD or DK. I’m certainly extremely skeptical about trusting the smaller sites.
