    Reading through it now. I wasn’t entirely convinced that DK/FD brought this on themselves with their action, but I’m now fairly certain they did. The NGC’s statement used a bunch of things that DK did against them in the decision. They may have still ruled against DFS no matter what, but it definitely helped the NGC reach their decision.

    For example – used by the NGC in support of their position is that:

    -DK applied for a license in the UK to operate as “pool betting” within the UK – “Although there is no question that the gambling laws of the United Kingdom and Nevada are fundamentally different, it is still noteworthy that the licenses in question are for ‘‘pool betting’’ and ‘‘gambling software,’’ and that DraftKings does not include either of those terms in its press release. Instead, DraftKings simply states that ‘‘the company has been granted a license to operate in the United Kingdom,’’ without identifying the licenses at issue. It appears that DraftKings recognizes the appearance of inconsistency between its position that it should be unregulated in the United States and its decision to submit to gaming regulation in the United Kingdom”
    -“Jason Robins (the owner, co-founder, and CEO of DraftKings) stated that the concept for DraftKings.com was ‘‘almost identical to a casino.’’)
    -” Additionally, the DraftKings CEO repeatedly refers to the payments on his sites as ‘‘wagers’’ and ‘‘bets,’’ and the activity as ‘‘betting.’’
    -My personal favorite – they had the “alt-text” of some of their pictures to include the words betting, almost definitely to try to get people who are google searching for “football betting” and the like.

    They definetly did some digging…. This didn’t happen over night or just over the last week IMO……they’ve been investigating this for a while and just now are laying down the gauntlet with all the information they laid out

    Even if they would have reached the conclusion they did, I find it interesting that point out several things DK did that only further boost their conclusion, but don’t mention FD even once. At the very least, DK gave them more ammo and FD made sure not to – if FD had said or done anything like what DK/Robbins did, I am pretty damn sure it would have been in this report.

    I think it’s possible the NGC had decided to make it illegal and reverse engineered the reasoning for it. In which case it didn’t really matter what the sites said or did.

    Yea, reading that reddit piece, they dug deeep, like, deeeeep.

    They let the Founder/CEO stay way too long. He should have been removed 1 year ago at the max, and replaced with a more executive type.

    All the would of should of’s.

    But the company grew so fast. Usually companies grow slower and have time to do that kind of stuff, like, before they go public, etc.

    Argh.

    Likely. But it speaks to FD’s ability to not shoot itself in the foot that the NGC basically found 4 blatant examples by DK to fit their agenda but none by DK. Whether it mattered, obviously, is something entirely different.

    I don’t disagree with anything in the OP, but unfortunately Nevada is clearly looking out for their own interests (casinos and their owners). Sheldon Adelson, if he didn’t last night, is going to be drinking his finest bottle of wine from his penthouse suite this evening while counting how this all will help his bottom line.

    The whole works stems from DFS growing into a multi-billion $ business and the government is pissed because they are not getting a big enough piece of the pie.States will want to regulate and attach permit fees and it will all go away.

    Yes.

    If dfs is sports betting, then only 4 states have the right to regulate it, it would be illegal everywhere else just like sports betting, because of the law known as PASPA.

    FD loses, DK loses and looks bad in the process probably better way to describe it. And of course, as you point out, all of us lose as well.

    After reading it i thought the exact opposite, they were going to do this no matter what, probably would have waited til after NFL season to release it but this controversy gave them cover

    Reading it through the 2nd time, I definitely see this point. So I guess I’m shifting more to the “Thanks DK for giving them a few more pieces of ammunition”. Still face-palming bad to see them note that DraftKings had graphics on their website that had alt-text of “betting”. Really guys? It was that important to show up on “football betting” google searches?

    Good point. I don’t know if I am more surprised that DK did that or that the NGC found it.
