Important: this is not an attack on Kyle, I’ve listened to some interviews with him and follow him on twitter and he seems like a cool guy, this is simply a question.

That being said, has anybody had experience with Kyle scooping your NHL h2h this year? I feel like he has scooped exactly 1 of my $1 h2h before i can even reload the page no matter what time I create the game. Is it possible he is using a script or software?

i really couldn’t think it’s any funnier than it is that you guys are flipping out over something i havent even cared about or thought about as I play every day, and make money. The TOS doesn’t matter to me. making money matters to me, i just put my lineups in win, why dont you all do the same?. You are all focused on the wrong things. Fanduel/DK, they will figure it out if there is something being violated. YOUR concern should be on winning, and not on other people who win.

This is what is lost in all of this. It goes from conspiracy to build better lineups because you suck to bulld better ways to let the sites know of these issues instead of a message board.

This definitely should be a violation, but regardless of whether this violates terms of service or not the bigger issue here is perception. This makes DFS look shady and scares away potential players. DFS is changing, it has become a lot more mainstream and now lawyers/journalists are chomping at the bit to get their hands on controversial/unethical actions. Hopefully the DFS industry and player community takes this opportunity to clean up questionable actions such as this for the greater good of DFS’ future.

Seems pretty ridiculous that you are allowed to have a script that scoop up games for you (even if its just 1). I can’t imagine new players post that many H2Hs to begin with and this seems like a pretty easy to make them quit playing.

The sites really could benefit from in-house counsel. If fanduel gave permission, that is the definition of making an individual exception to a generalized rule which is generally a terrible idea if you don’t notify all users of the exception. Just having the exception policy in place is a plantiff’s attorneys dream unfortunately.

Here’s what Fanduel says in their TOS about this. This was addressed in a post on RotoGrinders here.

Edit I’m not saying Kcannon’s script has been approved – I’m saying that those saying it’s violating Fanduel’s TOS are spreading misinformation because we don’t know if it has been approved or not.
