Following post made before NY news broke

    Hey Grinders,

The battle to keep DFS fully legal is still going on in some states, and obviously New York is an important one. Attorney General Eric Schneiderman is considering preventing New Yorkers from playing daily fantasy sports. There are over 500,000 daily fantasy players in the state of New York and AG Schneiderman would like to put in place restrictive measures that prevent your ability to play. It’s time for our community to come together and stand up against these unreasonable efforts.

If you live in New York, you can help now. Make sure AG Eric Schneiderman hears from you. Tell him you support daily fantasy sports for all in New York state. Daily fantasy sports is fun, entertaining and a game of skill. NY has bigger challenges than fantasy football.

Please contact the Attorney General Eric Schneiderman via phone, email, etc. at the details below, and visit this URL to petition

Yeah my illegal bookie friend just texted me welcoming Me back to the illegal sports gambling world…

  • durbinjag

I’m going to take the positive view. Their is going to be some huge overlay this weekend.

  • tysim19

As a NY resident, I truly believe we are in no immediate danger. I see the worst case scenario being a long drawn out legal battle with DK and FD losing. But that will take months if not a year. Play on for now!!

  • pburghpens22

Doesn’t New York have other crap to worry about, ugh

  • yanksfan1

If they fight this in court, which I assume they will, can they get a temporary restraining order? We need Judge Berman to hear this

  • jmac1204

So the same AG that conducted the DK investigation a month ago has now banned fantasy sports in his state. Am I seeing this correctly? There must be a correlation to the investigation.

So whats the bottom line for dfs players in NY? 5 days?

Could anyone help out with an answer to this?

  • Ravenfan

While this is true, and it’s true of staff here as well, especially some that are on the radio that chose to support their friendship with Ethan instead of considering the nightmare he caused, the actions of the AG of New York today are unlikely to hold up under legal scrutiny without banning all forms of gambling including horse racing in NY. That would mean the Belmont Stakes would no longer exist and those guys have too much political clout for that to ever happen.

FD and dk are going to court. No action for a while I’d say while we go through appeals etc

  • dafulv

It may be “illegal gambling” insofar as the legislature in New York has not passed a law authorizing it. New Yorkers should not only contact the AG’s office, they should contact their local State Assemblyman and Senator.

    False.

NY state law carves out exceptions for a number of gambling types. DFS just isn’t among them.

Cool, thanks! I debated withdrawing but decided to hold off for now. I did withdraw my contests for today though. That’s looking like a dumb move with my lineup doing so well lol.

Disagree to this point…online gambling for some reason is entirely different and not viewed in the same light.

The DK and FD lawyers just need to bring up the state lottery and horse racing being perfectly legal in NYS. That is true gambling, yet are allowed.

File every injunction, any and everything to keep this banning from happening and fight fight fight. If this does end up going down in NYS, then the industry is screwed. NY is the big fish, and will create a domino effect. The sites need to go all out right now or they’re done.

The Cease and Desist Letters served to Fanduel and Draftkings are for Fraudulent and Deceptive acts which are illegal.

    The Letter seen here: https://assets.documentcloud.org/documents/2511144/draftkings-letter.pdf

Outlines New York Codes Executive Law 63(12) and General Business Law 349

    Executive Law 63(12)-

“12. Whenever any person shall engage in repeated fraudulent or illegal acts or otherwise demonstrate persistent fraud or illegality in the carrying on, conducting or transaction of business, the attorney general may apply, in the name of the people of the state of New York, to the supreme court of the state of New York, on notice of five days, for an order enjoining the continuance of such business activity or of any fraudulent or illegal acts, directing restitution and damages and, in an appropriate case, cancelling any certificate filed under and by virtue of the provisions of section four hundred forty of the former penal law or section one hundred thirty of the general business law, and the court may award the relief applied for or so much thereof as it may deem proper. The word “fraud” or “fraudulent” as used herein shall include any device, scheme or artifice to defraud and any deception, misrepresentation, concealment, suppression, false pretense, false promise or unconscionable contractual provisions. The term “persistent fraud” or “illegality” as used herein shall include continuance or carrying on of any fraudulent or illegal act or conduct. The term “repeated” as used herein shall include repetition of any separate and distinct fraudulent or illegal act, or conduct which affects more than one person. In connection with any such application, the attorney general is authorized to take proof and make a determination of the relevant facts and to issue subpoenas in accordance with the civil practice law and rules. Such authorization shall not abate or terminate by reason of any action or proceeding brought by the attorney general under this section.” – See more at: http://codes.lp.findlaw.com/nycode/EXC/5/63#sthash.OdAC5Rx7.dpuf

    General Business Law 349 –

“(a) Deceptive acts or practices in the conduct of any business, trade or commerce or in the furnishing of any service in this state are hereby declared unlawful. (b) Whenever the attorney general shall believe from evidence satisfactory to him that any person, firm, corporation or association or agent or employee thereof has engaged in or is about to engage in any of the acts or practices stated to be unlawful he may bring an action in the name and on behalf of the people of the state of New York to enjoin such unlawful acts or practices and to obtain restitution of any moneys or property obtained directly or indirectly by any such unlawful acts or practices. In such action preliminary relief may be granted under article sixty-three of the civil practice law and rules….” – See more at: http://codes.lp.findlaw.com/nycode/GBS/22-A/349#sthash.LZrpgAEK.dpuf

    Long live DFS

Reading this is absolutely absurd when they say traditional fantasy sites is different from DFS. Fantasy Hub and all other DFS sites should take notice if this is the reasoning behind the C&D. FD and DK don’t take bets like they are the house. They provide a service just like traditional fantasy sites and the fees are built into the prize pool. The fact that there is the possibility of overlay means this isn’t a book-making process. Book-makers take bets as the house AND impose a rake; DFS sites take fees to ensure fair and guaranteed competition among participants. Rip them a new one DK and FD.

The New York Constitution (Article I, Sec. 9.1.) says that the New York legislature isn’t allowed to pass laws authorizing gambling … except for state lotteries and horse-racing.

It’s my understanding He never did any investigation into them, DK and FD said today he never even looked at their business models…DK hired former AG to do the only investigation I know of that has been concluded…

This is crazy. No hearings, no legislation or anything. Just a whimsical decision. Joke.

There’s plenty of legislation, much of it listed here: http://www.gambling-law-us.com/State-Laws/New-York/
