The four leagues and the NCAA collaborated to sue New Jersey, thus stopping any momentum toward legalization. After losing the case, New Jersey appealed the decision in September 2013, once again to no avail.
It would take another four years and at least three failed attempts to finally break any ground on the matter. In June 2017, the U.S. Supreme Court allowed the state of New Jersey to plead its case. This would be their final time doing so.
In May 2018, the Supreme Court decided to abolish the Professional and Amateur Sports Protection Act, the original legislation that imposed a nationwide ban on sports betting. Following this change, Nevada would no longer be the only state permitted to accept legal wagers.
Ohio’s Betting History
Ohio isn’t the first state that comes to mind when you think of gambling. Before 2009, all forms of gambling were illegal in the state. However, everything changed in November 2009 when Ohio residents voted in favor of a measure to allow four casinos in the state. The plan was to allow one casino in each major city, including Cleveland, Toledo, Columbus, and Cincinnati. Ohio’s Hurdles to Legalized Sports Betting
As we’ve discussed, the state of Ohio has long shown that it is not averse to gambling, with various casinos/racinos having opened their doors since 2012.
Unfortunately, Ohio would still face a few bumps toward legalized sports betting despite the groundbreaking overturning of PASPA. After failing to reach a consensus for years, and even a unanimous rejection in June, an agreement was finally reached in December 2021, thus paving the way for legalized sports betting to take place in Ohio.
It may have taken a bit longer than some of the other nearby states, but Ohio joined the legal sports betting community by going live with retail and online sportsbooks on January 1, 2023.
Ohio Sports Betting Legislative History
Legal sports betting discussions in Ohio began in 2018 and continued on until December of 2021.
2018
2018 marked the beginning of discussions about legalized sports betting apps in Ohio:
- PASPA was deemed unconstitutional in May 2018, opening the door for states to begin legal sports betting.
- In July 2018, Ohio State Senators John Eklund (R) and Sean O’Brien (D) introduced Senate Bill 316, a one-page, one-section bill “To express the intent of the General Assembly to develop and enact legislation legalizing sports wagering.”
- Senator O’Brien said that they left the bill extremely vague on purpose to let the people know that they are working on legislation and to chime in if they have any opinions. There were no specifics in the bill, and it was used as a placeholder for future discussions.
- Senator O’Brien believed that the best option for offering sports betting was through the state’s existing casinos/racinos.
2019
Politicians continued to lay the groundwork in 2019:
- On March 14, 2019, State Senator John Eklund (R) and Sean O’Brien (D) introduced a 146-page bill that would have regulated online and live sports betting.
- In the proposed bill, sports betting would be taxed at 6.25%, and application fees would be $100,000.
- Deliberation continued throughout 2019.
2020
In 2020, efforts to legalize sports betting built on past attempts and prepared for the successful approval the following year.
- In May 2020, the Ohio House passed a version of HB 194, which would officially legalize sports betting in the state (in-person and online/mobile).
- House sponsors backed the Ohio Lottery as the regulatory body, while the Senate wanted the Ohio Casino Control Commission (OCCC) to be in charge.
- In September it was reported that the House would cede to the Senate, paving the way for the OCCC to control sports betting in the state.
- The legalization ultimately stalled in December 2020 when time ran out. The House and Senate couldn’t agree on the number of skins allowed by each licensee.
2021
The end of 2021 cinched a significant victory for Ohio sports betting:
- On May 12, 2021, Senator Schuring debuted a new bill, SB176. This legislation bumped up the total number of available licenses to 40, splitting them evenly between mobile and retail operations. The bill passed through the Senate with a 30-2 vote.
- Upon realizing that SB176 would not meet the summer break deadline of June 30, Schuring implemented a new amendment to HB29, which included the legalization of sports betting.
- The new and improved HB29 would pass through the Senate, 31-0, on June 25, 2021. Unfortunately, the House was unable to make any decisions before summer break, pushing it back yet again.
- After months of ongoing negotiations, both sides finally agreed and officially passed HB29 in December 2021. The bill was signed into law by Governor Mike DeWine, and sports betting is now officially legal in Ohio!
While sports betting was legal in Ohio as of December 2021, retail and online sportsbooks didn’t go live until January 2023.
