Seminoles Hold The Cards

While the Seminole Tribe controls Florida sports betting, the state’s existing pari-mutuel facilities and “racinos” have long been eager to enter the market.

Under the 2021 gaming compact, these facilities are technically eligible to launch their own mobile sports betting brands. However, there is a massive catch: all mobile sports betting in Florida must be administered, managed, and processed through servers located on Seminole tribal property.

While pari-mutuels could theoretically negotiate agreements with commercial brands like DraftKings or FanDuel, the Seminoles would still manage all back-end operations and take a 40% cut of all revenue for their services.

Because of this restrictive revenue-sharing structure and the October 2024 legal settlement cementing the tribe’s monopoly, commercial operators currently have no viable path into the Florida market.

Unless the compact is radically altered—which is highly unlikely before it expires in 2051—Hard Rock Bet will remain the state’s sole online sportsbook.

It All Comes Down To Money

The 2021 compact that legalized sports betting in Florida was ultimately driven by a massive budget shortfall. Facing a $2.75 billion state deficit in the wake of the COVID-19 pandemic, Florida lawmakers desperately needed a major new revenue source.

The solution was a modernized gaming compact with the Seminole Tribe. By granting the tribe exclusive rights to offer statewide online sports betting and expanded casino games, the state secured a guaranteed minimum of $2.5 billion in new revenue over the first five years.

The Florida Legislature quickly passed the enabling legislation during a May 2021 special session, and the U.S. Department of the Interior allowed the lucrative compact to take effect that summer.

The legal battles that defined Florida sports betting for three years are over. The October 2024 settlement between the Seminole Tribe and West Flagler & Associates ended all litigation. Combined with the Supreme Court’s June 2024 refusal to hear WFA’s final appeal, the Seminole Tribe’s compact is firmly in place.
